PRIVACY POLICY AND INFORMATION NOTICE

This document explains how your personal data is processed when you use the Falyolu mobile app and the falyolu.com website. It is the information notice under Turkish Law No. 6698 on the Protection of Personal Data (KVKK), and it also contains the information required by the EU General Data Protection Regulation (GDPR) for our users in the European Union.

1. Data controller

2. Data we process

• Account details: email address, your name and date of birth (if provided), the identifier Apple provides when you sign in with Apple, guest account identifier, app language.
• Reading details: the name, date of birth, gender and relationship status you enter for a reading; for readings such as the horoscope star map, the time and place of birth and, if applicable, the same details of a second person; your question; the photos you send for a reading; your readings and the answers to your follow-up questions.
• Reviews and messages: the stars and reviews you give to readings, and your support and refund requests.
• Purchase details: product, date, store transaction number and point transactions. We do not see your card or bank details.
• Device and usage data: device ID, device model and operating system, notification token, in-app events (e.g. screens opened), IP address.

You do not need to share sensitive information, such as about your health or beliefs, in your questions. If you do, it is processed only to create your reading, based on the permission you give in the Explicit Consent.

3. Purposes and legal bases

• Providing the reading service (creating, storing and showing readings): conclusion and performance of a contract (KVKK Art. 5/2-c; GDPR Art. 6(1)(b)).
• Managing your account; points, purchases and refunds: performance of a contract and legal obligation (KVKK Art. 5/2-c and ç; GDPR Art. 6(1)(b) and (c)).
• "Your reading is ready", reminder and campaign notifications: your notification permission. You can turn off campaign notifications in Settings.
• Responding to support and refund requests: performance of a contract and legitimate interest.
• Improving the app and fixing errors (analytics): legitimate interest (KVKK Art. 5/2-f; GDPR Art. 6(1)(f)).
• Advertising measurement (Meta, only in app versions older than 1.9.0): your explicit consent; on iPhone, also your tracking permission.
• Security, preventing misuse and legal obligations: legal obligation and legitimate interest.
• Processing of sensitive information and transfers abroad: your explicit consent (KVKK Art. 6 and 9; GDPR Art. 9(2)(a)).

Your data is collected electronically through the app and the website, from the information you enter and automatically (software components in the app and server logs).

4. Creating readings with AI

Your paid readings and the answers to your follow-up questions are created with AI. For this, your first name, gender, relationship status, your birth year (for follow-up questions) and your question; your photos in coffee cup readings and palmistry; the dream you describe in dream reading; and, in the horoscope star map, your place and time of birth and, if applicable, the name and birth details of the person you are asking about are sent to our AI service provider, OpenAI; readings are also translated into other languages with OpenAI. Under OpenAI's API terms, this data is not used to train OpenAI's models and is kept for at most 30 days to monitor for abuse. Free readings are selected from interpretations prepared in advance; your data is not sent to AI for them. Support requests you send from the Contact section may also be sent to OpenAI so that they can be answered.

5. Recipients

We do not sell your data. We share it only as much as necessary with the following parties that help us provide the service:

• OpenAI (USA): creating readings and follow-up answers, identifying shapes in coffee cup reading and palmistry photos, translation, answering support requests.
• Amazon Web Services (Germany, Frankfurt): storing reading photos.
• Our server hosting provider (United Kingdom): app servers and database.
• Google: notifications and app analytics via Firebase; purchases via Google Play.
• Apple: Sign in with Apple, App Store purchases and notifications.
• Meta (Facebook): only in app versions older than 1.9.0, advertising measurement of app events. Version 1.9.0 and later send no data to Meta.
• Our email delivery infrastructure: account-related and campaign emails.
• Competent public authorities: only where required by law.

6. Transfers abroad

Some of these parties are located outside Türkiye (in the USA, the United Kingdom and the European Union). Your data is transferred to these countries only as far as necessary to provide the service, based on your explicit consent or on the safeguards provided for by applicable law.

7. Retention

• We keep your data as long as your account is open.
• When you delete your account, your account and reading details, questions, messages and review texts are deleted or anonymized immediately; your reading photos and your entry in our email list are deleted within a few hours at most.
• The stars you gave remain in the readers' ratings, with the link to you removed.
• Purchase records may be kept, separated from your personal details, for the period required by financial regulations.

8. Your rights

Under Article 11 of the KVKK and under the GDPR, you have the right to learn whether your data is processed, to request information, to request correction and deletion, to object to processing, to receive your data in a portable format, to withdraw your consent, and to lodge a complaint (in Türkiye with the Personal Data Protection Authority; in the EU with the data protection authority of your country). You can send your requests to iletisim@falyolu.com from the email address registered to your account; we will reply free of charge within 30 days at the latest.

9. Account and data deletion

In the app: Settings > Delete Your Account. Without the app: follow the steps at falyolu.com/hesap-silme or write to iletisim@falyolu.com.

10. Permissions

Camera and photos (for reading photos, only when you choose to), notifications (optional) and, in app versions older than 1.9.0 on iPhone, the tracking permission (optional, for advertising measurement). You can turn off permissions at any time in your device settings.

11. Security

The connection between the app and our servers is encrypted (HTTPS). Access to data is limited to authorized persons.

12. Children

Falyolu is not intended for children under 13. If we become aware that we are processing data of a child under 13, we will delete it.

13. Changes

We may update this document. We will announce important changes in the app.

TERMS OF USE

1. Acceptance

These Terms of Use govern the use of the Falyolu mobile app and the falyolu.com website ("Falyolu"). By using Falyolu, you confirm that you have read and accept these terms and the Privacy Policy and Information Notice. If you do not accept them, please do not use Falyolu.

2. The service

2.1. Falyolu is an entertainment app offering fortune-telling and astrology content such as coffee cup reading, palmistry, tarot, love reading, money reading, water reading, horoscope star map, dream reading and daily horoscopes.

2.2. The readers on Falyolu are AI characters, not real people. The characters' names are fictional; their photos and stories were created with AI.

2.3. Paid readings are generated with AI based on the reading type you choose and the information you share. Free readings are selected from interpretations prepared in advance with AI and are shorter than paid readings.

2.4. In paid coffee cup and palmistry readings, the AI also takes into account the shapes and lines in the photos you send when interpreting your reading; if no shapes can be identified in the photo, the reading is written without using the photo. In free readings, the photo is part of the fortune-telling ritual and is not examined. All readings are symbolic interpretations.

2.5. Readings and other content are for entertainment only. They do not predict the future and make no claim of certainty or accuracy. Do not rely on Falyolu content when making decisions about health, legal, financial, work or relationship matters; consult a qualified professional instead.

3. Age

Falyolu is not intended for children under 13. If you are under 18, use Falyolu and its purchase features only with the permission of your parent or guardian.

4. Account

4.1. You can use Falyolu as a guest, with Sign in with Apple, or by signing in with your email address.

4.2. You are responsible for keeping your account secure. If you notice any unauthorized use of your account, please write to us immediately.

5. Points and purchases

5.1. Paid readings and some features are used with in-app points. Points are virtual units valid only within Falyolu; they cannot be exchanged for money or transferred to others.

5.2. Points are purchased through Google Play or the App Store. Falyolu does not see or store your card or bank details. Prices are shown on the purchase screen.

5.3. Falyolu sets, and may change, the conditions of free point campaigns such as the welcome bonus, the wheel, scratch cards and coupons.

6. Refunds

6.1. If you are not satisfied with a paid reading, you can get its points back instantly within 30 days of the reading on the "Not satisfied? Refund" page in the app. This can be used once per paid reading and for at most one reading every 30 days.

6.2. You can also request a refund of the money you paid for points you have not used yet. For Google Play purchases, your request reaches us, the points added with that payment (including bonus points) are deducted from your account when you make the request, and the refund is made through Google Play. For App Store purchases, refunds are handled by Apple; the app takes you to Apple's refund page. If you get your payment back directly from Google Play instead of through the app, the points added with that payment are deducted from your account.

6.3. These options do not limit your rights under applicable consumer protection law.

7. User content and rules

7.1. You are responsible for the information, questions, photos and reviews you share. If you enter another person's details for readings such as the horoscope star map, make sure that person is aware of it.

7.2. It is prohibited to share content that is unlawful, insulting, hateful, violent or obscene or that infringes the rights of others; to misuse Falyolu, access it with automated tools, or attempt to harm its systems.

7.3. The stars you give to readings count towards the character's rating and number of reviews. Reviews you write may be published on reader profiles without your name. Reviews containing personal or contact information, questions or inappropriate language are not published.

7.4. Falyolu may remove content that breaks these rules and may suspend or close accounts that violate them.

8. Deleting your account

8.1. You can delete your account at any time in the app under Settings > Delete Your Account. Your account details, reading details, questions and messages are deleted or anonymized immediately. Your reading photos and your entry in our email list are deleted within a few hours at most.

8.2. If you cannot access the app, you can request deletion by following the steps at falyolu.com/hesap-silme or by writing to iletisim@falyolu.com from the email address registered to your account.

8.3. A deleted account cannot be restored; any points in it are also deleted.

9. Intellectual property

Falyolu's name, logo, design, software, characters and content belong to Falyolu. You may use Falyolu for personal, non-commercial purposes; you may not copy, reproduce or commercially use its content without permission.

10. Liability

10.1. Falyolu is provided "as is". We do not guarantee that the service will be uninterrupted or error-free; temporary interruptions may occur due to maintenance or technical issues.

10.2. Since readings are for entertainment, Falyolu cannot be held responsible for decisions you make based on reading content.

11. Changes

We may update these terms from time to time. We will announce important changes in the app. Continuing to use Falyolu after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Republic of Türkiye. Any mandatory rights you have as a consumer under the laws of your country remain unaffected.

EXPLICIT CONSENT

I have read the Falyolu Privacy Policy and Information Notice. I give my explicit consent to the following:

1. To provide the reading service, my first name, gender, relationship status, birth year and questions; my photos in coffee cup readings and palmistry; my dream in dream reading; and, in the horoscope star map, the birth details I enter in the form and, if applicable, the name of the person I am asking about may be transferred to and processed by the AI service provider OpenAI (USA).

2. My data may be hosted and processed abroad (in the USA, the United Kingdom and the European Union) through the service providers listed in the Privacy Policy.

3. Information I share in my questions that may be considered sensitive (e.g. relating to health or beliefs) may be processed only to create my reading.

I know that I can withdraw this consent at any time by writing to iletisim@falyolu.com or by deleting my account.
